End User License Agreement

1. Parties & Scope

This End User License Agreement ("EULA") is a legal agreement between you and NIBCARD Nig Ltd, trading as NIBCARD E Games ("NIBCARD," "we," "us"), governing your installation and use of any NIBCARD E Games application, including Land of Resistance, ESO, Ojelo, Oya One More, and Just Us (each, the "Software"). This EULA works alongside our Terms & Conditions; where the two conflict on licensing matters, this EULA controls.

2. Grant of License

Subject to your compliance with this EULA, NIBCARD grants you a limited, non-exclusive, non-transferable, revocable, personal license to download, install, and use one copy of the Software on devices you own or control, solely for your personal, non-commercial entertainment.

3. License Restrictions

You may not, and may not permit anyone else to:

• Copy, modify, adapt, translate, or create derivative works of the Software.
• Reverse-engineer, decompile, or disassemble the Software, except to the limited extent applicable law expressly permits despite this restriction.
• Rent, lease, lend, sell, sublicense, or otherwise transfer the Software or your license to it.
• Remove, obscure, or alter any proprietary notices on or in the Software.
• Use the Software to build a competing product or service.
• Circumvent any technical protection, anti-cheat, or licensing mechanism built into the Software.

4. Ownership

The Software is licensed, not sold. NIBCARD Nig Ltd and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights, all game assets, characters, music, and code. This EULA does not grant you any rights to NIBCARD's trademarks or brand assets.

5. Updates

We may provide updates, patches, or new versions of the Software from time to time. Some updates may be required to continue using the Software or specific features. This EULA applies to any updates unless a separate agreement is provided with that update.

6. Third-Party Components

The Software may include or rely on third-party software components (such as game engines, SDKs, or open-source libraries), which are licensed to you under their own respective terms in addition to this EULA.

7. Term & Termination

This EULA is effective until terminated. Your license terminates automatically if you fail to comply with any of its terms, or when you uninstall the Software or delete your account. Upon termination, you must stop using the Software and delete all copies of it from your devices. Sections relating to ownership, disclaimers, and limitation of liability survive termination.

8. Disclaimer of Warranty

The Software is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. NIBCARD does not warrant that the Software will be error-free or operate without interruption.

9. Limitation of Liability

To the maximum extent permitted by law, NIBCARD Nig Ltd will not be liable for any special, incidental, indirect, or consequential damages arising from your use of, or inability to use, the Software, even if advised of the possibility of such damages. Our aggregate liability under this EULA will not exceed the amount you paid for the Software, if any.

10. Export & Compliance

You agree to comply with all applicable export control and sanctions laws in your use of the Software, and confirm that you are not located in, or a resident of, any country subject to a comprehensive trade embargo that would prohibit your use of the Software.

11. Governing Law

This EULA is governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles, except where mandatory local consumer protection law provides otherwise.
